§ 1 Scope, Contracting Parties
(1) These Terms and Conditions apply to all orders placed by consumers (§ 13 BGB) via the online shop at cinesigns.com.
(2) Contracting party is:
CineSigns, Hauptstrasse 86, 63743 Aschaffenburg, Germany, email: info@cinesigns.com (hereinafter „Seller“).
(3) Deviating terms of the customer are not recognised unless the Seller expressly agrees to their validity in writing.
§ 2 Contract Language
The contract language is German. English-language versions of these Terms and other legal texts are provided for informational purposes only; in case of doubt, the German version shall prevail.
§ 3 Minimum Age
Orders are permitted only for persons who have reached the age of 18 and have unrestricted legal capacity. By placing the order, the customer confirms that they meet these requirements.
§ 4 Conclusion of Contract
(1) The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.
(2) By clicking the order button, the customer makes a binding offer to purchase the goods in the cart. Receipt of the order is confirmed without delay by email; this confirmation does not yet constitute acceptance of the offer.
(3) The contract is concluded with the dispatch of an express order confirmation or with the dispatch of the goods.
(4) The contract text is stored by the Seller. The customer receives the order details and the Terms by email. Subsequent inspection is possible via the customer account, where created.
§ 5 Prices and Shipping Costs
(1) All prices are final prices including statutory VAT and exclude shipping costs, which are shown separately during the order process.
(2) For deliveries to third countries (outside the EU), additional customs duties, taxes and fees may apply, which are to be borne by the customer.
§ 6 Delivery, Delivery Countries
(1) Delivery is made worldwide to the delivery address provided by the customer. Delivery to packstations is only available within Germany, where offered during the order process.
(2) No delivery is made to countries against which embargoes, trade or export restrictions of the European Union, the United Nations or the Federal Republic of Germany apply. Orders to such countries will not be accepted by the Seller; the customer will be informed without delay.
(3) Estimated delivery times are stated on the product page and during the order process. International deliveries may have different transit times.
(4) If an ordered item is unavailable, the customer will be informed without delay. Any payments already made will be refunded without delay in this case.
§ 7 Payment
(1) Payment is processed via the payment service provider Stripe. The payment methods available during the order process may vary depending on the delivery country and order amount.
(2) The purchase price is due for payment upon conclusion of contract, unless otherwise indicated for the chosen payment method.
§ 8 Retention of Title
The delivered goods remain the property of the Seller until full payment.
§ 9 Right of Withdrawal
Consumers have a statutory right of withdrawal. Details are set out in the Cancellation Policy.
§ 10 Warranty
(1) The statutory rights regarding defects apply. The warranty period is two years from receipt of the goods.
(2) Obvious transport damage should be reported to the carrier immediately and notified to the Seller. Failure to make such notification has no effect on statutory warranty claims.
§ 11 Liability
(1) The Seller is liable without limitation for damages arising from injury to life, body or health resulting from a negligent or intentional breach of duty, and for all damages based on intentional or grossly negligent conduct or fraudulent intent. Liability under the Product Liability Act remains unaffected.
(2) In the event of a slightly negligent breach of essential contractual obligations (cardinal obligations), liability is limited to typically foreseeable damages. Otherwise, liability for slight negligence is excluded.
§ 12 Final Provisions
(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as the protection granted is not withdrawn by mandatory provisions of the law of the country in which the consumer has their habitual residence.
(2) Place of jurisdiction is, where legally permissible, the registered office of the Seller in Aschaffenburg.
(3) Should individual provisions of these Terms be or become invalid, the validity of the remaining provisions shall remain unaffected.
